O-1签证是给在科学、艺术、教育、商业和体育领域内具有特殊才能的外国人签发的非移民签证。美国移民局近日发布了2019财年各类型签证的最新审批数据。尽管移民局的批准率处于下滑的趋势，O类签证的批准率却高于H类和L类的签证。
从2019财年第一季度的数据来看，O类签证的批准率为90.7%，RFE概率为27.8%，RFE之后被批准的概率为67.2%。
同H-1B签证一样，O-1签证无法自行申请，而是需要通过美国雇主(Employer)或代理经纪人(Agent)作为申请人(Petitioner)，杰出人才作为受益者(Beneficiary)进行申请。今天的文章中，我们将为大家分析O-1签证的几种雇佣形式，以及相应的签证申请方式。
O-1雇佣及申请方式
美国雇主雇佣：当O-1受益人为一位雇主工作时，雇主即可作为签证的申请人提交申请。申请时需将雇佣合同一并提交给移民局。与H-1B签证不同的是，O-1签证不存在prevailing wage的限制，雇主和雇员双方对薪资达成共识即可。
海外公司雇佣：若O-1签证的受益人受雇佣或经营的公司在海外，则无法直接为受益人申请签证。此时，需通过美国代理经纪人提出申请。代理经纪人可以是一家美国公司，也可以是一位美国公民。美国代理经纪人将同时代表海外公司及受益人本身。
自由职业者：若O-1受益人为自由业者，可由在美国代理经纪人进行签证申请。受益人在取得O-1签证后可为多位雇主工作，在申请签证时，需提交与多位雇主签署的合同，以及未来在美国的工作计划表。
除此之外，多为雇主可为自由职业的受益人提交多份O-1签证申请。每为雇主都作为O-1签证申请人，各自提交一份包含雇佣关系的申请文件，使受益人在签证期间能为这些雇主工作。
O-1更换雇主须知
O-1签证的有效期一般为3年，部分工作行程计划较短的受益人，所获批准函的有效期则会根据情况缩短。若在签证有效期内，O-1签证持有者需要更换雇主，则需要由新的雇主重新提交一份申请文件。
此外，若O-1签证持有者的工作的内容有较大的变化，须提交一份O-1 Amendment给移民局，来告知移民局在美工作计划的改变。
