纽约时间6月14日,我所商业诉讼部合伙人贡显之律师带领专业团队,在劳工赔偿委员会的听证审讯中为客户赢得全胜,避免了总数超过十万美金的赔偿及罚金。
我们的客户,A建筑公司与一家巴黎贝甜签订了店面翻新合同。因为没有相关执照,A公司向另一所拥有执照的B公司支付了一笔费用,以使用其执照进行必要的许可申请以及配备劳工赔偿保险。施工期间,现场工作的一位工人不慎从脚手架上跌落受伤,事后,该工人向A公司申请了劳工赔偿。如果A公司需要对此承担责任,可能面临:
工人受伤赔偿;
没有购买劳工赔偿保险的罚款(按照无保险的时间计算,每10天罚款$2000)。
审讯中,我们指出,B公司接受了我方客户A公司的费用,以其总承包商执照进行了许可的申请,劳工赔偿保险也由B公司配备,故应该由B公司为该受伤工人提供保险赔偿。而B公司则称,其并未提供劳务,也并未与需要翻新施工的巴黎贝甜签约,因此并不能被称为总承包商,从而不应该负责赔偿。最终,法官同意了我方立场,命令以B公司保险为该工人提供赔偿。同时,因为意外发生时,在施工现场确有有效的劳工赔偿保险,我们的客户A公司并不需要交付罚款。
